Hawaii Firearm Permits – Fisher v. Kealoha (2011)

In yesterday’s Fisher v. Kealoha (D. Haw. Apr. 19, 2011), the district court let plaintiff proceed with his Second Amendment claim, in a way that suggests plaintiff might well win. In December 1997, Kirk Fisher pled guilty to two counts of misdemeanor “harassment” of his wife (who is apparently still his wife), and was placed on probation for six months. As part of his probation, he had to surrender his guns, but after the probation was over, the court ordered that the guns be returned, so long as that was consistent with Hawaii law and federal law; and the police department did indeed return them.

The Foundation will be conducting a Hawaii gun safety course on the 22nd of April. This is a great opportunity to get you, or someone you know, the hands on experience required by State law and by participating in our pistol safety course.

This course is a basic introduction to firearms, and will cover a variety of topics to help you understand the inner working and proper use of your hand gun. Although this class teaches some marksmanship principals, it is mostly designed to ensure that you understand the basics of handgun safety in general; this understanding will help ensure that are fully capable of safely operating and using your firearm.

Good times, great friends, and quality training were the words of the day yesterday ts the Hawai’i Defense Foundation’s range training day. The turnout was good, and it would be safe to say that everyone in attendance learned something.

Alex Europa put his engineering skills to work this week to build a set of mobile target stands, which worked great and added a whole new dimension to training. Shooting at moving targets was a new experience for most of us, and was quite an eye-opener. There is certainly a lot to process when both the shooter and target are in motion, and Alex’s stands allowed students to get at least a little bit closer to real-world experience.

CGF Sues Los Angeles Sheriff

San Carlos, CA (March 9, 2012) – Continuing its Carry License Sunshine and Compliance Initiative, The Calguns Foundation (CGF) has filed a lawsuit today in Los Angeles Superior Court against Los Angeles Sheriff Leroy “Lee” Baca, the Los Angeles County Sheriff’s Department, and Los Angeles County. The case, entitled Jennifer Lu, et al. v. County of Los Angeles, et al., challenges the Sheriff’s ban on accepting and processing applications for carry licenses submitted by city residents.

The Calguns Foundation is joined in the lawsuit, by three individual plaintiffs.

“Sheriff Baca made the unfortunate decision to repeat historical failure,” noted CGF Chairman Gene Hoffman. “Apparently, the Sheriff and County do not feel bound to follow the precedent they set when the California Court of Appeals ruled against them in 1976. We look forward to refreshing their memory.”

Baker v. Kealoha et. al Hearing Date

As March rolls around, many of us are looking forward to the 21st. On this date, we will finally have an opportunity to go into the Federal District Court of Hawaii for the Baker v. Kealoha et. al. case regarding violations of our Second and Fourteenth Amendment rights. So who is ready? I know we are – it’s been a long time coming.

So what can we expect? We will have a variety of hearings and arguments for the motions that are set forth. On the table is the Motion to Dismiss from the State and the County, a request for the judgment on pleadings by the State, and our request for a preliminary injunction against them enforcing these unconstitutional laws for the duration of the case. Hawaii Defense Foundation presents Clark Neily co-counsel in D.C. v. Heller “Gun Litigation and Judicial Engagement”

On November 5th at 5:30 p.m. Clark Neily will be conducting a presentation for the Hawaii Defense Foundation on Gun Litigation and Judicial Engagement. Every day, judges are taking it upon themselves to distort the meaning and spirit of the United States Constitution, especially in the realm of the Second Amendment. Clark will be conducting a presentation to help explain some of this and how it can affect you as a firearm owner. Mr. Neily has graciously offered his assistance in this event. Proceeds will be put towards the Foundations litigation efforts in the State of Hawaii to support our firearms lawsuit (Baker v. Kealoha et. al).

It’s that time again! The Hawaii Historic Arms Association will be hosting the last gun show in Honolulu for the year. We are pleased to say that the Foundation will be present to spread our word on civil rights, firearms education, and self-sustaining skills like first-aid and CPR. We are looking for volunteers to help man the booth; if you would like to assist please call and speak to one us at 808-664-1827. We need help raising awareness! If you would like to volunteer any type of service we need help with printing, folding, and design work.
